Ordinance No. 8-15-150
An Ordinance Amending Existing Ordinance No. 8-15-150, “Dispensing Room Restrictions” To Include an Exception Allowing Minors in the Bar for the Limited Purpose of Dining.
Be it Ordained by the Governing Body of the Town of Lusk, Wyoming.
Section One: That Ordinance 8-15-150 in Title 8, Chapter 15 of the “Municipal Code of Lusk”, 2004, is amended and is adopted to read as follows:
8-15-150. Dispensing Room Restrictions, Exceptions.
(a) It is unlawful any person under the age of 21 years to enter or remain in the dispensing room or brewing area of any premises licensed or permitted under this chapter to dispense or brew alcoholic liquor or malt beverages, except as provided in this section.
(b) No Licensee, permittee or agent, employee, manager or servant of a licensee or permittee shall permit any persons under the age of 21 years to enter or remain in a dispensing room or brewing area of a licensed premises owned, operated, leased or managed by them except as provided herein under.
(c) Exceptions: This ordinance shall not apply to a licensee’s employee under the age of 21 years when, in the course of his or her employment, the employee is in the dispensing room and the dispensing room is not open for the sale or dispensing of alcoholic beverages or malt beverages. This ordinance does not apply to persons under the age of 21 years when such persons are in the dispensing room for dining only, provided that said person is accompanied by a person 21 years of age or older; and provided further that the same be allowed only between the hours of 11:00 a.m. to 8:00 p.m. In no case may a person under 21 years be seated or standing at the serving bar (bar top) nor may any person under the age of 21 years be permitted to consume alcohol. Smoking shall not be allowed on licensed premises between 11:00 a.m. and 8:00 p.m.
(d) The exceptions pertaining to Restaurant Liquor Licensees as set forth in W. S. § 12-4-401 shall apply to Restaurant Liquor Licensees.
